A charitable sale housed in the Paris showrooms of Christie’s displayed works created by European artists. These were painted over or on the backs of specially commissioned carved house shutters typical of the Zafimaniry region of Madagascar. The present article considers and contrasts the two types of creativity juxtaposed at the Christie’s sale. The European work stresses the artist’s individual originality and social isolation from the everyday lives of those who come to admire or buy the works. The process of (...) the art’s production ends abruptly at the moment of exhibition and sale. In contrast, the work of the Malagasy carvers is contained within a general concern of continuing the life and growth of their families. Their art intends to harden and beautify the houses that represent the continuation of the families’ life. There is no disconnection between the carver and those who will see and use the shutters similar to that of the European artists, and there is no clear beginning or end to the process of creation similar to the point of exhibition and sale. That is to say, as a domain of theoretical and practical knowledge, rhetoric is weakly institutionalized, lacking a centralized arbiter and standardized set of procedures for establishing truth claims. It also lacks the basic characteristics that Michel Foucault defines as disciplinary, for while we can identify (...) "groups of objects, methods, their corpus of properties considered to be true, the interplay of rules and definitions, of techniques and tools," these are neither universally admitted, nor do they "constitute a sort of anonymous system, freely available to whoever wishes, or whoever is able to make use of them, without their being any question of their meaning" (1972, 222). On the contrary, despite the fact that rhetoric is usually figured as offering practical and, indeed, positive knowledge, the meaning of its terms is always being questioned and at stake. While we might, by considering terms loosely, seek to identify rhetoric in terms of objects such as "persuasion," or "discourse," these are not exclusively its province. Furthermore, the ends of rhetoric are themselves unclear. Is rhetoric really the art of discovering the available means of persuasion? Or is it an art of citizenship? Or a method of enquiry? It has at times been defined as each. Consequently, none of these methods can fix its identity. At most, we can say that "rhetoric," as a domain of knowledge, signals a commitment to the idea of agency in discourse.Rhetoric, while not disciplinary, nevertheless "hangs together" as a domain of knowledge even though it does not cohere conceptually. It is, or comes close to being, a "discursive formation." That is to say, we can identify a field that produces statements concerning discourse and its operations, which is characterized by certain regularities that articulate with the term rhetoric itself. The rhetorical tradition, as something bequeathed or put in play by ancient teachers, appears to offer rhetoric a substance, a literature, and a set of problems, particularly through variants of two other principles of discursive formation identified by Foucault, commentary and the author-function. Even so, the gesture toward tradition does not imply the existence of a historically rooted and fixed corpus or model: "Tradition" is a vague term, there is no unproblematic canon of texts to be commented upon, and tradition itself, rather than Aristotle, Plato, or Cicero, stands as "author." The National Institute of Science and the Arts, founded in 1795, consists of parallel academies, concerned with science, literature, the visual arts and so on. In the nineteenth century it represented a unique government-sponsored intellectual authority and a supreme court judgement, a power which came to be resented by innovators of all kinds. The Académie des sciences held a virtual monopoly in representing French science but soon this came to be challenged. In the period of the Second Empire we find (...) a group of men carving out a new career for themselves as professional popularizers of science, commissioned to write regular articles in newspapers and journals. Although they had begun by simply reporting the meetings of the Académie des sciences, they soon widened their scope and even began criticizing the august Académie. Thus they represented the alternative voice of science, distinct from ‘official science’. These independent writers had their counterpart in painting and literature, both of which were developing radical new approaches in mid-century. When the very traditional Fine Art Academy refused to consider their paintings, painters like Cézanne and Manet found an alternative outlet. Writers too asserted their independence from the Académie française. There were not only many parallels between the independent practitioners in science, painting and literature but also new schools of ‘naturalism’ in painting and literature which looked to science as a model. Through an emphasis on the reception of Spinoza in German nineteenth-century thought, the volume seeks to shed new light on his work. Likewise, the focus on Spinoza’s influence in the long nineteenth century illuminates novel aspects of the philosophical lineage from idealism to Marxism, psychoanalysis, and beyond. The contributions are at the cutting edge of research on modern German thought, not only when it comes to canonical figures like Herder, (...) The significance of political-economic context for scientific citizenship is argued through an analysis of New Zealand’s Royal Commission on Genetic Modification. My intention is not to provide an account of why the commission came to the decisions it did but to illustrate how the political-economic context and the culture of regulatory science both exacerbate public concerns about unacknowledged uncertainty and commercial influence and make it difficult for those concerns to influence the outcomes of public dialogues. The discursive (...) flexibility of science as alternately predictive and provisional silences concerns about uncertainty, while a further interpretive choice of science as the autonomous activities of individuals unconstrained by political-economic context occludes the nature of concerns about commercial influence. Rather than the increasingly prevalent focus on processes of engagement, I argue that it is essential that researchers in this area attend to how public dialogue is placed in relation to the cultures and structures of regulatory science and neoliberalism. How do we use our mental images of the present to reconstruct our past? Maurice Halbwachs addressed this question for the first time in his work on collective memory, which established him as a major figure in the history of sociology. This volume, the first comprehensive English-language translation of Halbwach's writings on the social construction of memory, fills a major gap in the literature on the sociology of knowledge. Halbwachs' primary thesis is that human memory can only function within (...) a collective context. Collective memory, Halbwachs asserts, is always selective; various groups of people have different collective memories, which in turn give rise to different modes of behavior. Halbwachs shows, for example, how pilgrims to the Holy Land over the centuries evoked very different images of the events of Jesus' life; how wealthy old families in France have a memory of the past that diverges sharply from that of the nouveaux riches; and how working class construction of reality differ from those of their middle-class counterparts. A journey from cultural memory through recall to transformation of historical grievances is elucidated with the aid of phenomenological thought. The context for this study is a conflict resolution project undertaken by the Center for the Study of Mind and Human Interaction of the University of Virginia. Russians and Estonians of Klooga participated in a group meeting aimed at resolving ethnonational conflict. This meeting is described, and the potential of phenomenology in an interdisciplinary approach to conflict resolution is explored.

Citizenship rights have become vital to our sense of personal identity and social membership in modern society. Roche argues that today we have to shift from the conventional postwar politics of social rights to a new politics of social obligations and personal responsibility.

There are non-governmental organizations that operate transnationally and there are those that operate within the boundaries of a nation. A third use of non-governmental organizations is articulated. We may call this third category an instrumental use of non-governmental organizations to facilitate the transfer of the work of third-party conflict resolution practitioners to the two previously feuding parties. Representative accounts are provided in Part I of this paper. In Part II, the instrumental use of the NGO to transfer knowledge from practitioners (...) to the indigenous and previously feuding parties is depicted as a means to fill a practice gap in the field of conflict resolution, where many praxes do not examine the transfer of knowledge in an experiential and discovery-oriented way. An alternative is presented where the process of appropriation is suggested as an object of study. In Part III, a conceptualization of how one may determine the phenomenology of a sense of ownership of the project by the previously feuding parties is provided. A phenomenological account of the journey from constituting subjectivity to a constituted objectivity is articulated to the point where we see a division of labour between Husserl’s transcendental project, that seeks universal and broader essences, and psychology, which is highly contextualized. Part IV constitutes the implementation of the praxis to answer the specific question, “What is the sense of ownership of the parties in conflict?” - and, derivatively, “What is the fate of the hitherto agonistic relation?” A conflict resolution model is consolidated or reconfigured using the lessons drawn from the results of the study and from a second look at the literature to see where changes in practice and reconceptualization may be required. Children and adults from a remote Zafimaniry village in eastern Madagascar were probed for their intuitive understanding of the biological inheritance of bodily features. They were told a story about a baby adopted at birth, and were asked whether, when grown, he would be more likely to resemble his birth parents or his adoptive parents in bodily traits, beliefs, preferences, temperaments, and skills. In spite of the fact that the Zafimaniry, like other Southeast Asian and Malagasy peoples, profess explicit beliefs (...) concerning the fixation of individuals' properties that are at variance with Western folkbiology, Zafimaniry adults responded as do American adults on the task. Zafimaniry children, however, did not repond as did the adults, nor did they respond as did the majority of American children. Rather, they responded in the manner most consistent with what would be predicted, for children as well as for adults, from the ethnographic literature. That is, they tended to judge that an adopted boy would resemble his adoptive rather than his birth parents on virtually all traits, including bodily traits. The implications of these findings for current debates within cognitive science and anthropology are discussed. (shrink)

This paper examines the ethics of using assistive technology such as video surveillance in the homes of people living with dementia. Ideation and concept elaboration around the introduction of a camera-based surveillance service in the homes of people with dementia, typically living alone, is explored. The paper reviews relevant literature on surveillance of people living with dementia, and summarises the findings from ideation and concept elaboration workshops, designed to capture the views of those involved in the care of people living (...) with dementia at home. The research question relates to the ethical considerations of using assistive technologies that include video surveillance in the homes of people living with dementia, and the implications for a person living with dementia whenever video surveillance is used in their home and access to the camera is given to the person’s family. The review of related work indicated that such video surveillance may result in loss of autonomy or freedom for the person with dementia. The workshops reflected the findings from the related work, and revealed useful information to inform the service design, in particular in fine-tuning the service to find the best relationship between privacy and usefulness. Those who took part in the workshops supported the concept of the use of camera in the homes of people living with dementia, with some significant caveats around privacy. The research carried out in this work is small in scale but points towards an acceptance by many caregivers of people living with dementia of surveillance technologies. This paper indicates that those who care for people living with dementia at home are willing to make use of camera technology and therefore the value of this work is to help shed light on the direction for future research. I prefer to put this in a letter to you instead of writing an article that would lead one to believe that I have any authority to speak on the subject of what has, in a roundabout way, become the H. and H. affair . In other words, a cause of extreme seriousness, already discussed many times although certainly endless in nature, has been taken up by a storm of media attention, which has brought us to the lowest of passions, (...) intense emotions, and even violence. I understand why people are talking about Victor Farias, who has contributed some unpublished information—with a polemical intent, it is true, that does not help one to appreciate its true value. But how has it happened that Philippe Lacoue-Labarthe’s book, published in 1987, was greeted by a silence that I am perhaps the first to break?1 It is because he avoids anecdotal accounts, all the while citing and situating most of the facts mentioned by Farias. The loss or absence of vision is probably one of the most incapacitating events that can befall a human being. The importance of vision for humans is also reflected in brain anatomy as approximately one third of the human brain is devoted to vision. It is therefore unsurprising that throughout history many attempts have been undertaken to develop devices aiming at substituting for a missing visual capacity. In this review, we present two concepts that have been prevalent over the last (...) two decades. The first concept is sensory substitution, which refers to the use of another sensory modality to perform a task that is normally primarily sub-served by the lost sense. The second concept is cross-modal plasticity, which occurs when loss of input in one sensory modality leads to reorganization in brain representation of other sensory modalities. Both phenomena are training-dependent. We also briefly describe the history of blindness from ancient times to modernity, and then proceed to address themeansthat have been used to help blind individuals, with an emphasis on modern technologies, invasive (various type of surgical implants) and non-invasive devices. With the advent of brain imaging, it has become possible to peer into the neural substrates of sensory substitution and highlight the magnitude of the plastic processes that lead to a rewired brain. Finally, we will address the important question of the value and practicality of the available technologies and future directions. (shrink)

In the process of psychical transmission from one generation to the next, who asks what of whom? The evocative expression of an ‘errand’ suggests that a subject is sent on a mission, sent in error, wanders away, and returns home, adversely changed. A vocative imperative is at the heart of a mission. When there is a call from an anterior Other, there must be a response. Before, there was an experience of a call and its response, then, there would be (...) an errand. Precisely, the subject is preceded by the self-same subject’s constituted and appropriated mandate from an anterior object. To upend an aberrant errand, a subject must reconfigure a posted imperative, ever altering, again and again, the call and summons of an alien and unwelcome guest turned host. Otherwise, the dissonant and unwelcome guest turned host may transform the naïve subject into a ghost, a revenant that disappears and returns to haunt the subject. Thanks to the new and public space in the clinical setting, the entity that listens to the sub-ject will come to know that reception and perception of an errand is communalised in ways where there is a constant alteration, revision and co-creation of meanings of the received and perceived phenomenon through reciprocal connection and reciprocal correction. When subject’s experiential acquisitions enter that clinical setting, a resolute upending of a retrogressive descent toward death may occur. Hence, the meaning of staying alive for an Other who is otherwise dislocated, thrown, posted into a transgenerational spiral, toward death. A toxic errand is thus potentially aborted in that new space where a new relationship for resubjectivising and sublimating the unwanted mandate happens. Resubjectivising the injected errand becomes the exit strategy so that positive change is now conceivable. (shrink)

In this article, we describe the influence of violations of community standards of fairness on subsequent ethical decision-making and emotions. Across two studies, we manipulated explanations for a common action, and we find that explanations that violate community standards of fairness lead to greater intentions to behave unethically than explanations that are consistent with community standards of fairness. We find that perceptions of justifiability mediate this relationship. We also find that individuals derive significant psychological benefits from engaging in unethical behavior (...) following perceived violations of fairness. (shrink)

Belgium is now the second country in the world, next to the Netherlands, that has legislation which under certain conditions legitimizes euthanasia. In this article the Belgian legislative procedure on euthanasia is looked upon from a political point of view. To be able do so first of all the legal context on euthanasia before the new bill was approved of has to be discussed. (...) Maurice Blanchot, the eminent literary and cultural critic, has had a vast influence on contemporary French writers—among them Jean Paul Sartre and Jacques Derrida. From the 1930s through the present day, his writings have been shaping the international literary consciousness. The Space of Literature , first published in France in 1955, is central to the development of Blanchot's thought. In it he reflects on literature and the unique demand it makes upon our attention. Thus he explores the process of (...) reading as well as the nature of artistic creativity, all the while considering the relation of the literary work to time, to history, and to death. Whereas Pasteur patented the biotechnological processes that he invented between 1857 and 1873 in the agro-food domain, he did not file any patents on the artificial vaccine preparation processes that he subsequently developed. This absence of patents can probably be explained by the 1844 patent law in France that established the non-patentable status of pharmaceutical preparations and remedies, including those for use in veterinary medicine. Despite the absence of patents, the commercial exploitation of the anthrax vaccine in the 1880s and (...) 1890s led to a technical and commercial monopoly by Pasteur’s laboratory as well as the founding of a commercial company to diffuse the vaccine abroad. Pasteur repeatedly refused to transfer his know-how and anthrax vaccine production methods to foreign laboratories, on the grounds that he wished to control the quality of the vaccines produced. Indeed, it was relatively difficult to transfer a method that was not yet perfectly stabilized in the early 1880s. Pasteur also wanted to maintain the monopoly of his commercial company and to increase the profits from vaccine sales so that the Institut Pasteur could be financially independent. BackgroundKnowledge development depends on an unbiased representation of the available evidence. Selective citation may distort this representation. Recently, some controversy emerged regarding the possible impact of swimming on childhood asthma, raising the question about the role of selective citation in this field. Our objective was to assess the occurrence and determinants of selective citation in scientific publications on the relationship between swimming in chlorinated pools and childhood asthma.MethodsWe identified scientific journal articles on this relationship via a systematic literature search. The (...) following factors were taken into account: study outcome (authors’ conclusion, data-based conclusion), other content-related article characteristics (article type, sample size, research quality, specificity), content-unrelated article characteristics (language, publication title, funding source, number of authors, number of affiliations, number of references, journal impact factor), author characteristics (gender, country, affiliation), and citation characteristics (time to citation, authority, self-citation). To assess the impact of these factors on citation, we performed a series of univariate and adjusted random-effects logistic regressions, with potential citation path as unit of analysis.ResultsThirty-six articles were identified in this network, consisting of 570 potential citation paths of which 191 (34%) were realized. There was strong evidence that articles with at least one author in common, cited each other more often than articles that had no common authors (odds ratio (OR) 5.2, 95% confidence interval (CI) 3.1–8.8). Similarly, the chance of being cited was higher for articles that were empirical rather than narrative (OR 4.2, CI 2.6–6.7), that reported a large sample size (OR 5.8, CI 2.9–11.6), and that were written by authors with a high authority within the network (OR 4.1, CI 2.1–8.0). Further, there was some evidence for citation bias: articles that confirmed the relation between swimming and asthma were cited more often (OR 1.8, CI 1.1–2.9), but this finding was not robust.ConclusionsThere is clear evidence of selective citation in this research field, but the evidence for citation bias is not very strong. Digital phenotyping is the term given to the capturing and use of user log data from health and wellbeing technologies used in apps and cloud-based services. This paper explores ethical issues in making use of digital phenotype data in the arena of digital health interventions. Products and services based on digital wellbeing technologies typically include mobile device apps as well as browser-based apps to a lesser extent, and can include telephony-based services, text-based chatbots, and voice-activated chatbots. Many of these digital (...) products and services are simultaneously available across many channels in order to maximize availability for users. Digital wellbeing technologies offer useful methods for real-time data capture of the interactions of users with the products and services. It is possible to design what data are recorded, how and where it may be stored, and, crucially, how it can be analyzed to reveal individual or collective usage patterns. The paper also examines digital phenotyping workflows, before enumerating the ethical concerns pertaining to different types of digital phenotype data, highlighting ethical considerations for collection, storage, and use of the data. A case study of a digital health app is used to illustrate the ethical issues. The case study explores the issues from a perspective of data prospecting and subsequent machine learning. We argue in this paper that so-called new wave reductionism fails to capture the nature of the interlevel relations between psychology and neuroscience. Bickle (1995, Psychoneural reduction of the genuinely cognitive: some accomplished facts, Philosophical Psychology, 8, 265-285; 1998, Psychoneural reduction: the new wave, Cambridge, MA: MIT Press) has claimed that a (bottom-up) reduction of the psychological concepts of learning and memory to the concepts of neuroscience has in fact already been accomplished. An investigation of current research on the phenomenon (...) of long-term potentiation reveals that this claim overstates the facts. Both the psychological and the neural concepts involved have not yet stabilized and face further correction under the influence of both bottom-up and top-down selection pressures. In addition, psychological concepts often refer to functions, and functions are indispensable and irreducible. Function ascriptions pick out objective patterns involving historical factors and distal goals. This view of functions implies that psychological facts cannot be simply read off from the neurophysiological facts. Although psychological theorizing is constrained by neurophysiology (and vice versa), psychology remains distinct at least to some degree. (shrink)

This article presents an empirical study of approaches to ethical decision-making among nurses and doctors. It takes as its starting point the distinction between the perspectives of care and of justice in ethical thinking, and the view that nurses' thinking will be aligned with the former and doctors' with the latter. It goes on to argue that the differences in these approaches are best understood in terms of the distinction between partialist and impartialist modes of moral thinking. The study seeks (...) to determine the distribution of these modes of thinking between nurses and doctors, and finds that there are no signif icant differences between them. A 'two-level' philosophical view of the nature of moral thinking is appealed to in order to explain the study findings. (shrink)
